1. The Club will charter Sailing Yachts and/or Motor Vessels for leisure boating for its members and prospective members. 2. The club will be non-profit making and any assets or cash balances at the end of the year will be jointly owned by the Club and carried forward to the following year.
3. The Club year will run from the 1st of January to the 31st of December. The annual accounts will be audited at the end of the year and presented to the AGM that will be held in February of each Club year.
4. Membership to the Club will be by invitation only and all prospective members will be interviewed by the Membership Committee. Sailors at all levels of experience will be eligible for membership, i.e. beginners to yachtmasters.
5. A joining fee of £15.00 and an annual membership fee of £20.00 will be paid by each member to cover the administration costs, navigation charts and almanacs etc. The annual membership fee will be reviewed and set at the AGM and to be paid by the members by the 1st of March.
6. The Long John Silver Sailing Club supports the R.N.L.I. and requests that members join the R.N.L.I. by the beginning of their second year of membership.
7. Charter Rules and Regulations
7.1 All charter fees will be paid equally by the members that are participating in the charter.
7.2 Non-members will be charged an administration fee for participating on the Charter which is refundable when they join the Club.
7.3 All charter participants will be bound by the Charter Agreement and it is up to the individual participants to familiarise themselves with the Charter Agreement.
7.4 All charter participants are equally responsible for payments to cover costs of the vessel including mooring fees, Harbour dues, fuel and victualing etc.
7.5 On agreement to participate in a particular Charter, a deposit must be paid, this is non-refundable unless a replacement member agrees to take over the berth.
7.6 The balance of the Charter fees must be paid by the participants 21 days before the Charter date or earlier if demanded by the Charter Company.
7.7 Security Deposit Although the vessel will be fully insured a security deposit is charged by the charter company. This will cover the insurance excess and any damage to the vessel and its inventory that is not included in the insurance cover. This shortfall will be deducted from the security deposit. One member from the participants will volunteer to arrange the Security Deposit ( usually by Credit Card ).
7.8 All participants will be equally responsible for deductions made from the Security Deposit to cover loss or damage to the vessel or its contents or any third parties liability however caused.
7.9 All demands for payment by the guarantor under the above clause must be made within seven days.
7.10 Insurance Insurance policies differ slightly and it is important that each participant understands the contents that is particular to the Charter.
7.11 Personal Insurance. Each participant must have their own cover for death, personal injury or the loss of their own possessions or equipment. The Club shall have no liability for any loss, damage or injury to the participants or their equipment and possession
8. Charters
8.1 Before each charter a meeting will be called at a convenient time and location for the participants to discuss various topics, i.e. passage plans, allocation of berths, finances, victualing etc. A Passage Plan will be produced and a second meeting may take place if necessary nearer the Charter date to finalise arrangements.
8.2 One member of each Charter shall volunteer to be the ships Purser and he will be responsible for the ships petty cash, obtain receipts and make a log of all expenses paid out on the Charter. A second participant will act as the Auditor.
8.3 All participants must be familiar with departure times at the various ports, we must ensure that no-one goes "walkabouts" when the vessel is due to depart. This is particularly important on the final leg when a delayed departure may result in late return of the vessel of the vessel to the Charter Company and possible extra costs.
8.4 Safety. There is a No Smoking policy at all times below deck, however smoking may be permitted on deck at the discretion of the Skipper.
8.5 When on board a vessel the participants must take reasonable care not to cause damage to the vessel or its equipment.
8.6 All participants must familiarise themselves with all the safety equipment on board and know how to use them before the yacht leaves its moorings
8.7 On matters of safety of the vessel and crew the Skippers decision is final
9. No monies can be spent or any asset disposed of without the consent of the Commodore, Treasurer or the Secretary. Any monies spent or asset disposed of without the required consent will be at that member’s own expense.
10. Club Name The Club name can only be used for booking charters etc. by the three Club Officers – Commodore, Treasurer or Secretary or with their consent.
In conclusion, any organisation must have basic rules to avoid any misunderstandings. the above are all common sense and safety related and we must remember that the whole point of The Long John Silver Sailing Club is for every member to enjoy themselves and have fun.
